Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “user”) and CodeCraft Interactive LLC (“we,” “us,” or “our”) governing your access to and use of the WildSoul mobile application and related services (the “Service”).

By creating an account, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Cookie Policy (collectively, the “Agreements”). If you do not agree, do not use the Service.

2. Eligibility

To use WildSoul, you must:

• Be at least 18 years old. No exceptions. We verify age during registration.
• Not be prohibited from using the Service under applicable law or previously banned by us.
• Not be a registered sex offender in any jurisdiction.
• Have the legal capacity to enter into a binding agreement.

We reserve the right to request age verification at any time and to terminate accounts that fail verification.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must immediately notify us at support@wildsoul.app if you suspect unauthorized access.

You agree to provide accurate, current, and complete information during registration and to keep your profile information updated. Impersonation, fake profiles, and misleading information are prohibited.

You may not transfer, sell, or share your account with any other person.

4. Subscriptions and Payments

4.1 Free and Premium Tiers

WildSoul offers a free tier (“Pup”) and premium subscription plans (“Pack,” “Alpha,” “Ancestral Spirit”). Features and limitations of each tier are described in the App and may change from time to time.

4.2 Billing

Premium subscriptions are billed on a recurring basis (monthly or yearly, depending on your selection). By subscribing, you authorize us to charge your chosen payment method at the beginning of each billing period.

4.3 In-App Purchases

Subscriptions purchased through the Apple App Store or Google Play Store are subject to the respective store's terms and billing practices. Apple and Google process payments on our behalf; we do not receive your full payment card details.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You retain access to premium features until the period expires. No partial refunds are provided for unused portions of a billing period.

4.5 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing period. If you do not agree with a price change, cancel before it takes effect.

4.6 Refunds

Refund requests are handled according to the policies of Apple or Google. We may grant discretionary refunds on a case-by-case basis.

5. User Conduct and Content

5.1 Your Content

You retain ownership of content you post (“User Content”). By posting, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and promoting the Service.

5.2 Prohibited Conduct

You agree not to:

• Harass, bully, stalk, threaten, or intimidate any user
• Post sexually explicit, violent, or illegal content
• Use the Service for any commercial, advertising, or solicitation purpose
• Impersonate another person or misrepresent your identity, age, or affiliation
• Upload malware, viruses, or harmful code
• Scrape, crawl, or use automated means to access the Service
• Attempt to circumvent security measures, rate limits, or subscription restrictions
• Use the Service to discriminate against, abuse, or harm any individual or group
• Share another user's private information without their consent
• Create multiple accounts for deceptive purposes

Violation of these rules may result in immediate account termination.

5.3 Content Moderation

We reserve the right (but have no obligation) to review, remove, or restrict User Content that violates these Terms. We may use automated systems and human review to enforce community standards.

6. Safety and Reporting

WildSoul provides block and report tools in the App. If you experience harassment or encounter a profile that violates our Terms, please report it immediately. We review all reports and may take action including warning, suspension, or permanent ban.

Important: WildSoul does not conduct criminal background checks on users. You are solely responsible for your personal safety when interacting with other users, both online and in person. Exercise caution and common sense.

7. Intellectual Property

The Service, including its design, features, code, branding, and content (excluding User Content), is owned by CodeCraft Interactive LLC and protected by copyright, trademark, and other intellectual property laws.

“WildSoul,” the WildSoul logo, and all related marks are trademarks of CodeCraft Interactive LLC. You may not use our trademarks without prior written permission.

8. Third-Party Services

The Service integrates with third-party services (RevenueCat, Apple, Google, Cloudinary, MongoDB Atlas). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be uninterrupted, error-free, or secure.

WE DO NOT GUARANTEE the conduct, identity, or compatibility of any user. We are not responsible for any interactions between users, whether online or offline.

We make no representations or warranties regarding the accuracy of user profiles, the suitability of matches, or the outcome of any user interaction.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CodeCraft Interactive LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (b) $100 USD.

Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless CodeCraft Interactive LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

12.2 Informal Resolution

Before filing any formal claim, you agree to attempt to resolve the dispute informally by contacting us at support@wildsoul.app. We will attempt to resolve the dispute within 60 days.

12.3 Arbitration

If informal resolution fails, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in Hillsborough County, Florida, or remotely at your election.

12.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS ONLY. You waive the right to participate in any class action, class arbitration, or representative proceeding.

12.5 Exceptions

Either party may seek injunctive relief in any court of competent jurisdiction for violations of intellectual property rights or confidentiality obligations.

13. Termination

You may delete your account at any time through the App (Settings → Delete Account) or by contacting support@wildsoul.app.

We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service immediately ceases.

Sections 7, 9, 10, 11, 12, and 14 survive termination.

14. General Provisions

• Entire Agreement. These Terms, together with the Privacy Policy, Acceptable Use Policy, and Cookie Policy, constitute the entire agreement between you and us.
• Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
• Waiver. Our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment. We may assign these Terms without restriction. You may not assign your rights without our written consent.
• Force Majeure. We are not liable for failures due to circumstances beyond our reasonable control (natural disasters, war, pandemic, government action, internet disruption).

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide at least 30 days' notice via in-app notification or email. Continued use of the Service after the effective date constitutes acceptance.
